Terms and Conditions - Sambandhaar

Welcome to Sambandhaar - Family Tree Builder ("Sambandhaar" or "the App"), an online product of the Lakshmi Balaji O2O Platform ("the Platform"), owned and operated by M/s. Lakshmi Balaji ORS Private Limited ("the Company"), a private limited company incorporated under the laws of India, with its Corporate Office at 54, G-1, Sarvalakshmi Homes, Srinivasa Nagar Main Road, Hasthinapuram, Chennai 600044, India.
By accessing or using Sambandhaar, you ("User" or "You") agree to be bound by the following Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and M/s. Lakshmi Balaji ORS Private Limited.
1. Acceptance of Terms
1.1. By using Sambandhaar, you confirm that you have read, understood, and agreed to these Terms and Conditions, as well as any future updates or modifications that may be made from time to time.
1.2. The Company reserves the right to modify these Terms at its sole discretion without prior notice. Continued use of the App after such modifications constitutes your acceptance of the revised Terms.
2. Description of the App
2.1. Sambandhaar is a web-based application designed to assist Users in creating and managing family tree records. It is provided as a tool for personal use and convenience.
2.2. The App is hosted on a static platform (e.g., Blogger) and operates entirely on the User's device. No data entered into Sambandhaar is stored on any online server or database maintained by the Platform or the Company.
3. Disclaimer: No Data Stored Online
3.1. Sambandhaar operates offline on your device. All data entered by you, including personal information, family details, or any other content, is processed locally and is not transmitted to, stored on, or retained by the Lakshmi Balaji O2O Platform, M/s. Lakshmi Balaji ORS Private Limited, or any third-party servers.
3.2. Any data exported by you (e.g., as PDF or CSV files) is your responsibility. The Company does not retain copies of such data and is not liable for its loss, misuse, or unauthorized access after export.
4. Use at Your Own Risk
4.1. You acknowledge and agree that your use of Sambandhaar is entirely at your own interest and risk. The App is provided "as is" without any warranties, express or implied, including but not limited to accuracy, reliability, or fitness for a particular purpose.
4.2. Neither the Lakshmi Balaji O2O Platform, M/s. Lakshmi Balaji ORS Private Limited, nor its promoters, directors, employees, or affiliates shall be held responsible or accountable for any consequences arising from your use of the App, including but not limited to data loss, errors in family tree records, or any legal or personal disputes.
5. Eligibility
5.1. To use Sambandhaar, you must be at least 18 years of age and capable of entering into a legally binding agreement under the Indian Contract Act, 1872.
5.2. If you are using the App on behalf of another person or entity, you warrant that you have the authority to do so and accept these Terms on their behalf.
6. User Responsibilities
6.1. You are solely responsible for maintaining the confidentiality of your login credentials (username and password) provided for accessing Sambandhaar.
6.2. You agree not to use the App for any unlawful purpose or in any manner that violates applicable laws, including the Information Technology Act, 2000, and rules thereunder.
6.3. You shall not attempt to reverse-engineer, modify, or distribute the App’s code or content without prior written consent from the Company.
7. Intellectual Property
7.1. Sambandhaar, including its design, code, and branding, is the intellectual property of M/s. Lakshmi Balaji ORS Private Limited. All rights, title, and interest in the App are reserved.
7.2. You are granted a limited, non-exclusive, non-transferable license to use Sambandhaar for personal, non-commercial purposes only, subject to these Terms.
8. Limitation of Liability
8.1. To the fullest extent permitted by law, neither M/s. Lakshmi Balaji ORS Private Limited, the Lakshmi Balaji O2O Platform, nor its promoters, directors, employees, or affiliates shall be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Sambandhaar.
8.2. This includes, but is not limited to, damages for loss of data, privacy breaches, or any disputes arising from the information you enter into the App.
8.3. The Company does not guarantee uninterrupted or error-free operation of the App and is not liable for any technical issues, including those caused by third-party hosting platforms (e.g., Blogger).
9. Indemnification
9.1. You agree to indemnify, defend, and hold harmless M/s. Lakshmi Balaji ORS Private Limited, the Lakshmi Balaji O2O Platform, and its promoters, directors, employees, and affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising out of your use of Sambandhaar or violation of these Terms.
10. Termination
10.1. The Company reserves the right to suspend or terminate your access to Sambandhaar at any time, with or without notice, for any reason, including suspected misuse or violation of these Terms.
10.2. Upon termination, your right to use the App ceases immediately, but these Terms shall survive to the extent applicable (e.g., liability, jurisdiction).
11. Governing Law and Jurisdiction
11.1. These Terms shall be governed by and construed in accordance with the laws of India.
11.2. Any dispute, controversy, or claim arising out of or relating to these Terms or your use of Sambandhaar shall be subject to the exclusive jurisdiction of the courts in Chennai, India.
11.3. All proceedings shall be conducted in the English language only.
12. Force Majeure
12.1. The Company shall not be liable for any failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, acts of government, war, or technical failures (e.g., internet outages).
13. Severability
13.1. If any provision of these Terms is found to be invalid or unenforceable under Indian law, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
14.1. These Terms constitute the entire agreement between you and M/s. Lakshmi Balaji ORS Private Limited regarding your use of Sambandhaar and supersede any prior agreements or understandings, whether written or oral.
